These Terms and Conditions govern the sale and use of the SWAM Access Manager plugin and related digital services provided by Jarosław Skawski. By purchasing, downloading, installing, activating, or using SWAM Access Manager, you agree to these Terms and Conditions.
1. Definitions
Product means the SWAM Access Manager plugin, including updates, documentation, license keys, and related digital deliverables.
License means the limited, non-exclusive, non-transferable right to use the Product under these Terms.
Customer means the individual or business purchasing the Product.
Services means any separately paid setup, installation, configuration, onboarding, customization, migration, consulting, or implementation work.
2. Nature of the Product
SWAM Access Manager is a digital software product intended for WordPress and WooCommerce environments. The Product is licensed, not sold. No ownership rights in the software are transferred to the Customer.
3. License Scope
Unless otherwise stated in the purchased offer or plan:
- one license is valid for one production website / one domain,
- the license is granted for one year from the date of purchase,
- the license includes access to updates and support during the active license period,
- staging or development use may be allowed only if explicitly supported by the applicable licensing model.
The Customer may not:
- resell, sublicense, redistribute, or share the Product,
- make the license key publicly available,
- use one license on multiple unrelated production websites,
- remove, bypass, or interfere with licensing, security, or update mechanisms.
4. Paid Setup and Additional Services
The purchase of the Product does not include installation, setup, onboarding, access mapping, course creation, WooCommerce mapping, customization, or any other implementation work unless explicitly stated otherwise in a separate offer or invoice.
Any setup, onboarding, implementation, or other Services are billed separately.
5. Orders and Payment
Orders are completed once payment has been successfully received and confirmed. After successful payment, the Customer may receive a license key, download instructions, access instructions, or other information necessary to use the Product.
The seller reserves the right to refuse, suspend, or cancel an order in cases of suspected fraud, abuse, chargeback risk, licensing abuse, or violation of these Terms.
6. Pricing and Taxes
Prices are displayed in the currency shown at checkout and may be subject to applicable taxes, including VAT, where required by law. The Customer is responsible for providing correct billing details.
7. Renewals
The Product is sold as a recurring annual license unless stated otherwise. If the license is not renewed, the Customer may lose access to updates and support. The Product may continue to function only to the extent technically allowed by the licensing model in use.
8. Support
Support is provided only for customers with an active license, unless otherwise agreed.
Support covers, in particular:
- installation and activation guidance,
- reproducible Product issues,
- support within the officially supported scope of the Product.
Support does not automatically include:
- third-party plugin conflicts,
- theme issues,
- custom development,
- server administration,
- custom front-end design work,
- content creation or course population,
- unagreed bespoke integrations.
9. Updates
Updates are available during the active license period, unless stated otherwise. The Product may be improved, maintained, modified, patched, or extended over time.
10. Compatibility
The Customer is responsible for ensuring that the hosting environment, WordPress version, PHP version, WooCommerce version, and related software are compatible with the Product.
Compatibility with every third-party plugin, theme, custom codebase, or outdated environment is not guaranteed.
11. Refund Policy
A refund request may be submitted within 14 days from the date of purchase.
Refunds may be granted where the Product has a reproducible technical issue, materially does not work as described, or no reasonable solution can be provided within that period.
Refunds may be refused where the issue is caused by third-party software, hosting, unsupported custom code, abusive conduct, or where separately paid Services have already been started or completed.
Paid Services, including setup, onboarding, implementation, or customization, are generally non-refundable once work has started, unless otherwise agreed in writing.
12. Intellectual Property
All intellectual property rights in the Product remain the sole property of Jarosław Skawski. The Customer receives only the limited license described in these Terms.
13. Prohibited Conduct
- reverse engineering, decompiling, or attempting to bypass licensing or protection mechanisms, except where such rights cannot legally be excluded,
- distributing modified copies of the Product,
- using the Product in a way that infringes law or third-party rights,
- misusing support, download, update, or licensing systems.
14. Suspension and Termination
Access to updates, support, license services, or related digital delivery may be suspended or terminated in cases of non-payment, chargeback, fraud, license abuse, or breach of these Terms.
15. Limitation of Liability
To the maximum extent permitted by law, the Product is provided on an “as is” and “as available” basis. No guarantee is given that the Product will operate uninterrupted or error-free in every environment.
The total liability arising from the purchase or use of the Product shall not exceed the amount actually paid by the Customer for the relevant license period.
The seller is not liable for lost profits, lost revenue, lost business opportunities, indirect or consequential damages, or data loss resulting from misuse, lack of backups, third-party conflicts, hosting issues, or unauthorized modifications.
16. Customer Responsibility
